Due process hearings for 26 professional and occupational licensing boards and commissions: These matters include license disciplinary actions, appeals from provisional denials of licensure applications, and hearings on applications for reinstatement following licensure suspensions and revocations. Licensure disciplinary actions are taken pursuant to the following statutes:

  • 63 P.S. § 148 et seq. - The Engineer, Land Surveyor and Geologist Registration Law.
  • 63 P.S. § 211 et seq. - The Professional Nursing Law
  • 63 P.S. § 244.1 et seq. - The Optometric Practice and Licensure Act.
  • 63 P.S. § 271.1 et seq. - The Osteopathic Medical Practice Act.
  • 63 P.S. § 390.1 et seq. - The Pharmacy Act.
  • 63 P.S. § 422.1 et seq. - The Medical Practice Act of 1985.

Hearings and appeals are conducted pursuant to the Administrative Agency Law (2 Pa.C.S. § 101 et seq.), and the General Rules of Administrative Practice and Procedure (1 Pa. Code § 31.1 et seq.).. Hearings are generally held in Harrisburg with some hearings held in the Pittsburgh, Philadelphia and Scranton areas.

  • 63 P.S. § 2201 et seq. - "Act 48." The Department conducts a high number of hearings on behalf of the State Board of Cosmetology. These hearings are license disciplinary actions involving cosmetologists and manicurists, pursuant to 63 P.S. § 507 et seq., the Beauty Culture Law, and 63 P.S. § 2205, "Act 48." Hearings and appeals are conducted pursuant to the Administrative Agency Law (2 Pa.C.S. § 101 et seq.), and the General Rules of Administrative Practice and Procedure (1 Pa. Code § 31.1 et seq.). Formal hearings are generally held in Harrisburg with some hearings held in the Pittsburgh, Philadelphia and Scranton areas. All Act 48 citation hearings are held in Harrisburg

  • Bureau of Commissions, Elections and Legislation

    Due process hearings in actions related to the revocation and suspension of notaries public, pursuant to 57 P.S. § 147 et seq., the Notary Public Law of 1953. Hearings and appeals are conducted pursuant to the Administrative Agency Law (2 Pa.C.S. § 101 et seq.), and the General Rules of Administrative Practice and Procedure (1 Pa. Code § 31.1 et seq.). Hearings are generally held in Harrisburg with some hearings held in the Pittsburgh, Philadelphia and Scranton areas.

  • Bureau of Charitable Organizations

    Due process hearings related to the revocation and suspension of registered charitable organizations and professional solicitors, and the imposition of civil penalties, Pursuant to 10 P.S. § 162.1 et seq., the Solicitation of Funds for Charitable Purposes Act. Hearings and appeals are conducted pursuant to the Administrative Agency Law (2 Pa.C.S. § 101 et seq.), and the General Rules of Administrative Practice and Procedure (1 Pa. Code § 31.1 et seq.). Hearings are generally held in Harrisburg.

  • Corporations Bureau

    Actions seeking the cancellation of trademarks pursuant to 54 Pa.C.S. § 1101 et seq., the Pennsylvania Trademark Act, and actions to strike fraudulent finance statements under 18 Pa.C.S. § 4911, the Uniform Commercial Code. Hearings and appeals are conducted pursuant to the Administrative Agency Law (2 Pa.C.S. § 101 et seq.), and the General Rules of Administrative Practice and Procedure (1 Pa. Code § 31.1 et seq.). Hearings are generally held in Harrisburg.
