A. Lead Abatement Notification

Act 44 of 1995 and its regulations require that the Department of Labor & Industry (Department) be notified of work where lead-based paint is present and that persons certified by the Department perform this work whenever the following will occur:

  • Lead-based paint is to be removed or abated using a method that will last greater than 20 years from housing in which children (less than 6 years old) are present and this removal is not taking place as part of a renovation/alteration of housing.

  • Lead-based paint is removed or abated using a method that will last greater than 20 years from "target housing" --- any housing constructed prior to 1978 , except housing for the elderly or person with disabilities (unless any one or more children age 6 years or under resides or is expected to reside in such housing for the elderly or persons with disabilities) or housing units that lack bedrooms. (If the removal is part of a renovation/alteration project, no notification is required.)

Note: There is no threshold for this notification based on the amount of lead-based paint present. If lead-based paint is present and will be removed in the dwellings described above, notification must be sent, and certified individuals must perform the abatement work.

When notification is required, a contractor must complete the Department of Labor & Industry's Lead Abatement Notification Form (LIBI-600L).

This form must be emailed to CALBOIS@pa.gov, faxed to 717-705-0196 or mailed to the Department at least five (5) days (Monday-Sunday) before the date that abatement work will begin. The Department’s mailing address is as follows:

If an emergency situation exists, this five (5) day requirement may be waived. To obtain a waiver, call the Department of Labor & Industry at 717-772-3396 between 8 a.m. and 4 p.m., Monday through Friday. If the waiver is granted, directions will be provided for faxing or emailing the notification form. This office's email address is CALBOIS@pa.gov and fax number is 717-705-0196.

B. Lead Occupations Certification (Initial)

Please read and follow the directions for each category listed below.

All but the contractor certification application forms require the applicant to include her/his latest training information and the certificate for this training. For applicants who took training in Pennsylvania, the application must be submitted and certification obtained within six months of completion of training (interim date listed on the training certificate). For applicants who took training in another state, the initial training certificate and all subsequent refresher certificates must be submitted with the application to show there has been no lapse of training. Applications that lack this information or the course certificate(s) will not be processed.

Applicants must provide information pertaining to any enforcement actions taken against him/her.

All applicants must pay the specified certification fees, unless they are employees of and perform abatement work exclusively for the following entities: a federal, state, local government or not-for-profit agency. Fees are based on the anniversary date of the training certificate.

Applicants for the Building Inspector, Risk Assessor or Supervisor certification should note carefully the information found in Section E, regarding the special exam which they must pass in Pennsylvania before certification can be obtained.

Certification is issued through the training certificate’s anniversary date. For example: If you apply for your PA Lead Worker certification on May 1, 2009, with your training certificate, which was issued on January 1, 2009 and valid through January 1, 2012, then your Pennsylvania certification will be issued as valid through January 1, 2010. In January of 2010, you would apply again with the same training certificate and would be issued a certification valid through January 1, 2011. You would do this again in January 2011 for certification through January 1, 2012. Prior to January 1, 2012 you would need to take a refresher course and use that training certificate for the number of years it is valid.

For Contractor Certification: Initial and Renewal

  • Complete the Lead Contractor Certification Application (LIBI-613L).

  • Provide payment via check or money order made payable to the Commonwealth of Pennsylvania. (Same fee applies to initial or a renewal certification.) Click here for the fee schedule.

Note: This application must contain the certification number and name of an individual in this company that has been certified in the category "Supervisor" by the Department of Labor & Industry. The contracting firm will not be certified if an employee in the company has not been so certified.

For Worker Certification:

  • Complete the Application For Lead Occupation Certification (LIBI-607L).

  • Provide a copy of the Worker certificate(s) for your EPA or PA approved training course(s).

  • Provide information regarding any enforcement actions taken against you, following directions on page 2 of form LIBI-607L.

For Project Designer Certification:

  • Provide a copy of the Project Designer certificate(s) for your EPA or PA approved training course(s) as well as a copy of your Supervisor certificate(s).

  • Complete the Verification of Degree for Lead Occupation Certification (LIBI-614L) form.

  • Complete the Verification of Experience for Lead Occupation Certification (LIBI-615L) form. (See EPA 40 CFR Part 745.226 for further clarification.) Your work experience must reflect “from – to” dates as shown in the table below and all experience must be listed on the form itself (no attached resumes since this is a notarized form):

C. Lead Occupations Certification (Renewal)

Pennsylvania's lead occupations certification is good for a period of one year.

In accordance with current EPA standards found under 40 CFR section 745.226, there is no grace period to take refresher training for lead occupations. Therefore, to be consistent with EPA standards, effective January 15, 2007, all individuals will be required to take refresher training prior to the expiration date of their current training certificate in order to renew their Pennsylvania lead occupation certification. If your current training certificate has expired, you will be required to retake the initial training course and apply for initial certification.

To renew certification in any category of work, applicants must:

  • Complete the Application For Lead Occupation Certification (LIBI-607L).

  • Provide a copy of the certificate for your most recent EPA or PA approved training course as well as any certificate you’ve obtained since last issued a PA lead license. This training certificate must be valid (it cannot have expired) at the time of application. Certification is issued through the training certificate’s anniversary date. For example: If you apply for your PA Lead Worker certification on May 1, 2009, with your training certificate, which was issued on January 1, 2009 and valid through January 1, 2012, then your Pennsylvania certification will be issued as valid through January 1, 2010. In January of 2010, you would apply again with the same training certificate and would be issued a certification valid through January 1, 2011. You would do this again in January 2011 for certification through January 1, 2012. D. Lead Training Accreditation and Related Requirements

Training providers have a number of responsibilities that must be met, to offer courses related to lead-based paint abatement. These include:

  • Obtaining Department of Labor & Industry accreditation.

  • Notifying the Department five (5) days (Monday-Sunday) before the start date of when a training course will be offered.

  • Ensuring that all training participants have signed in on the Department's form, and submission of this form to the Department (within five (5) days of completion of the training).

  • Completing an evaluation of each training participant and submitting this to the Department (within five (5) days of completion of the training).

Detailed information about complying with each of these requirements is as follows:

OBTAINING ACCREDITATION:

Before offering any lead abatement training courses, providers must obtain Department of Labor & Industry accreditation.

To obtain accreditation, the following must be submitted:

  1. Page 1 of the Department's Lead Training Course Accreditation Application (LIBI-603L), with all requested information filled in.

  2. Payment of the required fees via check or money order made payable to the Commonwealth of Pennsylvania or proof of non-profit status (Fees are waived for non-profit providers). Click here for the fee schedule.

  3. Copies of supporting documentation for each course previously accredited by the U.S. Environmental Protection Agency or another state.

  4. Description of the facilities and equipment to be used for lecture and hands-on training.

  5. A copy of each Instructor’s resume.

  6. A copy of the Quality Control Plan, which will show the procedures for periodic revision of the training materials and course test to reflect innovations in the field and the procedures for the training manager’s annual review of the principal instructor(s) competency.

  7. Complete information on the content of each course for which you are seeking Pennsylvania accreditation. The following must be included:
    1. The curriculum, including:

      1. Length of training (in days).
      2. Topics covered.
      3. Amount and type of hands-on training.
      4. Length, format and passing score for examination(s).

    2. Copies of all course materials including student manuals, instructor handbooks, handouts and examinations.

    3. Description of how the examination was developed.

    4. Description of the activities and procedures that will be used for conducting the assessment of hands-on skills.

    5. Sample of the certificate issued to trainees upon the successful completion of the course.

The Department of Labor & Industry will review accreditation applications within 30 days of their receipt. If the package is acceptable, a Certificate of Accreditation will be issued, after which the applicant may begin offering lead abatement training courses.

NOTIFICATION OF COURSES TO BE OFFERED:

Whenever an accredited training provider intends to offer a course, it must submit a completed Lead Training Course Notification Form (LIBI-605L) to the Department of Labor & Industry five (5) days (Monday-Sunday) before the start date of when the training course will be held.

This form should be emailed to CALBOIS@pa.gov or faxed to 717-705-0196.

SIGN-IN SHEET FOR TRAINING PARTICIPANTS:

On each day of a scheduled training, the provider must have all participants sign in (for both morning and afternoon sessions, as applicable) on the Department of Labor & Industry's Lead Trainee Sign-In Sheet (LIBI-610L).

Within five (5) days of completion of the training, the sign-in sheet(s) along with the completed trainee evaluations should be emailed to CALBOIS@pa.gov, faxed to 717-705-0196 or mailed to:

TRAINEE EVALUATIONS:

The provider must ensure completion of an evaluation for each participant using the Department of Labor & Industry's Lead Trainee Evaluation Form (LIBI-606L).

Note: Trainees must fill in information and provide their signatures at the top of this form; so, providers must distribute and collect these forms before trainees leave the course.

Within five (5) days of completion of the training, the evaluation forms along with the completed sign-in sheet(s) should be emailed to CALBOIS@pa.gov, faxed to 717-705-0196 or mailed to:

E. Special Exam Requirement for Building Inspectors, Risk Assessors and Supervisors

Building Inspectors, Risk Assessors and Supervisors must pass an exam developed by the U.S. EPA, in order to obtain certification (in addition to satisfying all the requirements found in Section B).

The Department of Labor & Industry is currently administering the EPA developed lead exam virtually. This method is individually proctored and does require the applicant to have a computer with a good internet connection that has audio AND video capability. Exam time slots are provided to applicants on a first come, first serve basis. To apply for this exam, submit the following to the Department of Labor & Industry:

  1. A completed Registration For Lead Occupation Certification Exam (LIBI-622L). Be sure to check the box next to "Initial Exam," if this is your first time taking the PA Exam in a particular certification category, and list your correct mailing address, personal email address and a telephone number where you can be reached during the day. You cannot be scheduled for your exam if all the required information is not listed on your Registration form.

  2. A non-refundable fee via check or money order made payable to the Commonwealth of Pennsylvania. All applicants must pay this fee, even government and not-for-profit employees. Click here for the fee schedule.

  3. A copy of your most recent training certificate issued by an EPA or PA accredited training provider. If training was taken in Pennsylvania, the exam must be taken, passed and license issued before the Interim Expiration date listed on the training certificate. If training was taken in another state, the initial training certificate and all subsequent refresher certificates must be submitted with the application to show there has been no lapse of training.

  4. If registering to take the Risk Assessor exam, complete the following:

    1. The Verification of Degree for Lead Occupation Certification (LIBI-614L) form.

    2. The Verification of Experience for Lead Occupation Certification (LIBI-615L) form. (See EPA 40 CFR Part 745.226 for further clarification.) Your work experience must reflect “from – to” dates as shown in the table below and all experience must be listed on the form itself (no attached resumes since this is a notarized form):
