Industrial Board

Appeal/Variance/Extension of Time Request Procedure

To make an application, a copy of the appropriate Industrial Board Petition must be submitted along with the items specified on the form.

Board staff review any applications (petitions) submitted to the Board. If a submission is deficient (i.e. lacks plans, required fee or other information) the Board will return the submission to the petitioner. The Board will review properly completed petitions and determine if they can handle the request as a direct action or if a personal hearing must be scheduled. The Board endeavors to act upon complete submissions within 60 days.

If a hearing is necessary, the Board will notify the petitioner in writing of the date, time and location of the hearing. Otherwise, the petition will be presented to the Board for direct action at a regularly scheduled meeting. After the Board renders a decision, an Industrial Board Order is issued to the petitioner.

The Buildings Section of the Bureau of Occupational & Industrial Safety reviews plans before they are submitted to the Industrial Board for action. This review is necessary to ensure that all matters requiring Board action are addressed. Visit our Building Codes section for information on the plan review process.

Submission Requirements:

  1. One copy of the completed Uniform Construction Code (UCC) – Industrial Board Petition (BK1) (Form LIIB–117).
    • This request must be submitted by the owner of the building or his representative.
    • A separate request form must be used for each Section of the Code requiring a variance.
  2. One set of drawings, including floor plans.
  3. A check or money order in the amount of $100 payable to the Commonwealth of Pennsylvania.

Fire and Panic - Buildings

  1. One copy of the completed Industrial Board Petition Fire and Panic K–1 (Form LIIB–115).

Boilers

Submission requirements:

  1. One copy of the completed Boiler Variance/Appeal/Extension of Time Request – Industrial Board Petition (DK1) (Form LIIB–303).
    • A separate request must be submitted for each boiler installation requiring a variance.
  2. One copy of the completed Intent to Install Boiler (Form LIBI–302) for each unit to be installed.
  3. If moving a boiler, one copy of the completed Permit to Move Boiler or Unfired Pressure Vessel (Form LIBI–301) and a copy of the Manufacturer's Data Report for each unit being moved.
  4. Three sets of boiler or mechanical room plans on paper not less than 18" x 24", drawn to a scale of a minimum ¼" = 1'–0", including the following:
    • Floor plan of boiler or mechanical room showing all equipment and objects.
    • Elevation of boiler or mechanical room showing the breaching and smoke pipe if a variance from the 72" overhead clearance is requested.
    • Dimensions of all equipment clearances. Clearances are measured from the boiler or from any pipe appendage extending beyond the boiler.
  5. Two separate checks or money orders made payable to the "Commonwealth of Pennsylvania".
    • One for the variance in the amount of $100.00 per building.
    • One for the Intent to Install in the amount indicated below based on the number of boilers.

Unfired Pressure Vessels

Submission Requirements:

  1. One copy of the completed Unfired Pressure Vessel VarianceAppeal/Extension of Time Request – Industrial Board Petition (DK1) (Form LIIB–305).
    • A separate request must be submitted for each unfired pressure vessel that requires a variance.
  2. If moving an unfired pressure vessel, one copy of the completed Permit to Move Boiler or Unfired Pressure Vessel (Form LIBI–301) and a copy of the Manufacturer's Data Report for each unit being moved.
  3. Check or money order in the amount of $100.00 (per building) made payable to the "Commonwealth of Pennsylvania".
  4. No Fee Required for Extension of Time Requests.

Elevators and Other Lifting Devices

Submission Requirements:

  1. One copy of the completed Elevators and Other Lifting Devices Variance/Appeal/Extension of Time Request - Industrial Board Petition (EI1) Form LIIB–118).
    • A separate request form must be submitted for each building.
    • A separate request form must be used for each piece of equipment if the variances requested for each are different.
  2. One set of drawings, if requested.
  3. Check or money order payable to "Commonwealth of Pennsylvania".

    Fee Schedule

    Variances (Industrial Board Fee) $100.00 (per building)
    Extension of Time Requests $100.00

Liquefied Petroleum Gas

Submission Requirements:

  1. One copy of the completed Liquefied Petroleum Gas Variance/Apeal/Extension of Time Request - Industrial Board Petition (GK1) (Form LIIB–122).
    • A separate request must be submitted for each installation that requires a variance.
  2. One copy each of the Following completed forms:
  3. Three sets of plans on paper not less than 18" x 24" for any of the following:
    • Tanks over 2,000–gallon individual water capacity.
    • Fixed Location with aggregate capacity exceeding 4,000 gallons.
    • Exchange Cabinets
    • Dispensing stations to fill cylinders
  4. Plans must include the following information:
    • Location of all tanks.
    • Size of all tanks including ASME data reports for tanks.
    • Distances from all buildings/property lines.
    • Fencing (fence around tanks) when required.
    • Traffic flow patterns.
    • Fire protection provided.
    • Vehicle protection (bollards, jersey barriers, etc.).
  5. Fire Safety Analysis if required by Section 6.25 of NFPA–58 (2008).
  6. A manufacturer's Data Report (UI-A) for all ASME Tanks or a PA Special/PA Standard #.
  7. Two separate checks or money orders made payable to the "Commonwealth of Pennsylvania".
    • One for the variance or extension of time in the amount of $100.00 per location.
    • One for the plan approval and registration.

Flammable and Combustible Liquids

Submission Requirements:

  1. One copy of the completed Flammable & Combustible Liquids Variance/Appeal/Extension of Time Request Industrial Board Petition (SK1) (Form LIIB–121).
    • A separate request must be submitted for each installation that requires a variance.
  2. One copy of a completed F&C Liquids Intent to Install (Form LIBI–703).
    • Indicate physical location address, PO boxes are not acceptable.
  3. If installing an aboveground tank and related pumps or drawing–off devices, one copy of a completed Aboveground Tanks/Pumps/Dispensers (Form LIBI–702).
  4. If installing an underground tank and related pumps or drawing–off devices, one copy of a completed Underground Tanks/Pumps/Dispensers (Form LIBI–701).
  5. If installing an attended, self–service fueling station, one copy of a completed Attended Self–Service Station (Form LIBI–700) and one copy of a completed Underground Tanks/Pumps/Dispensers (Form LIBI–701)
  6. If the installation involves Ethanol–85% tanks and related equipment, one copy of a Ethanol–85 Installation (Form LIBI–706).

        

  7. A site plan including the following information:
    • Location of all tanks.
    • Sizes of all tanks.
    • Location of any buildings or structures.
    • Distances from all tanks to any buildings or structures.
    • Distances from all tanks to the property lines.
    • Vehicle protection (bollards).
    • Traffic flow patterns.
    • Lines of site when the installation is at an attended self–service site, including camera usage, if applicable.
  8. If requesting a variance regarding distance to a property line, a letter from adjacent property owners stating their approval of the installation distance must be submitted.
